Abstract:

The paper presents a critical analysis of the provisions of the regulatory legal acts of the Russian Federation that establish the procedure for sending information about the boundaries of the territory of a cultural heritage site (including an archaeological heritage site) to the Federal Register for Registration in the Unified State Register of Real Estate. As a result of the analysis of these norms and extensive judicial practice, the authors identified contradictions between the provisions of legislation in the field of protection of cultural heritage objects and legislation in the field of state registration of rights to real estate and transactions with it and formulated a number of proposals for improving legislation. The authors also studied the problem of legal regulation of the turnover of land plots occupied by archaeological sites.

It is established that judicial practice demonstrates different legal approaches of courts to solving the problem under consideration. According to the authors, the principle of separate location in civil circulation of a land plot and an object of archaeological heritage, fixed in clause 2 of Article 49 of the Federal Law “On Cultural Heritage Sites (Historical and Cultural Monuments) of the Peoples of the Russian Federation”, cannot always be respected.
