Abstract:

The article conducts a comprehensive analysis of the problems related to the phenomenon of the court (or process) using various methods of scientific research. Such a statement of scientific problem meets the current issues of procedural theory and legal practice development. Observing the development of judicial and non-judicial proceedings, the author considers that the key question is how to assess the role of these different types of procedural institutions in modern socio-economic and legal life. This article offers an alternative to the usual ideas about judicial and non-judicial methods for resolving disputes obtained by classification method. This is due to the fact that judicial and non-judicial procedures tend to borrow individual elements from each other. The circumstance makes it difficult to choose between procedures both for the parties of disputes and for the procedural system in general. Instead, avoiding any classification, the author considers them as equivalent forms of protection of rights and interests, which have their own value based on ways of making decisions, their goals and objectives, and their ideas.
