Abstract:

Adoption of the Federal Law "On Alternative Dispute Resolution involving mediation (Mediation)" (later "The Mediation Law") resulted in a change of procedural law. At the same time the legislator has not taken into account the complex nature of mediation, which requires legal regulation of its certain aspects, not only by procedural but also by substantive law. While providing the possibility of using the mediation process to resolve individual labor disputes, the legislator did not consider the presence of some features of its application to relations regulated by labor law. In the present article the necessity of special approach to mediation as a form of reconciliation between the parties of the conflict is proved. In the case of noting the widespread practice of inadequate application of mediation procedures for the resolution of individual labor disputes, the author summarizes the situations where these procedures may be useful and effective. Some proposals for the improvement of the labor legislation of the Russian Federation based on experience and scientific knowledge of domestic and foreign scholars are formulated in the article.
