Power and law: the experience of methodological analysis

Abstract:

The author views the correlation between the public power and law comparing and revealing their identity in the principal concepts of law comprehension. Therefore the fundamental essence of the legal matter is exposed on the basis of S.S. Alekseev's works. For the first time positive law is considered as the part of public power. The specific issues of the positive law influence on the public-power relations and vice versa are analyzed. The particular impartial (independent from the public power) nature of the positive law is scrutinized. The article also contains some facts concerning the comparison of law and public power relations from the sociological, psychological, historical points of view. In addition substantiation of law and power correlation as the whole and its parts is given in the article. On the whole the research is aimed at determination of the identity of power and law, regardless of its legal sense.
