Public legal basis for the participation of medical organizations in the system of genomic technologies application

Abstract:

A medical organization acts as the subject of public law relations, which mainly ensures the implementation by citizens of the norms of Article 41 of the Constitution of the Russian Federation aimed at preserving public health. The active development of genomic technologies is gradually transforming not only diagnostic and treatment methods, but also organizational approaches to their implementation. Such transformational processes naturally affect healthcare institutions, including public and private medical organizations. Considering all of the above, this article focuses on determining the place of medical organizations in the system of public relations related to the use of genomic technologies. The author analyzes the organizational structure of the healthcare system, that combines state, municipal and private elements, as well as the model of financing through the Compulsory Health Insurance Fund, stimulating competition for patients. Based on the legal definition of a medical organization, its essential features are highlighted.
