Abstract:

Civil servants, like other workers, have special needs arising from combining their official duties with caring for family members. In legal science, little attention is paid to the issues of constructing a system of social and labor guarantees for employees. The purpose of this work is to fill this gap and formulate proposals aimed at improving the system of labor guarantees for civil servants with family responsibilities. The study concludes that civil servants should have the right to a set of guarantees similar to those of ordinary employees, ensuring the combination of responsibilities for fulfilling professional and family duties. At the same time, the involvement of civil servants in public administration requires a balanced approach to safeguarding private and public interests. Guarantees for civil servants must not conflict with the principles of continuity, adequacy, and security of public administration. This makes the system of guarantees for civil servants distinct from the system of guarantees for ordinary employees. Limitations or expansions of the scope of guarantees for civil servants must be consistent with established societal notions of fairness and the priorities of public administration, objectively justified, and proportionate to the purposes for which they are established.
