Abstract:

The article analyzes the doctrinal positions of leading domestic constitutionalists regarding the nature of the institution of citizenship and the permissible conditions for its termination. To date, the concept of “termination of citizenship” has not been defined at the regulatory level. Although the current Federal Law No. 138-FZ of April 28, 2023 “On Citizenship of the Russian Federation” contains an extensive conceptual framework, it does not include a corresponding definition. Law enforcement and judicial practice have already been established, but discussions about the compliance of the mechanism for terminating citizenship with the fundamental principles enshrined in Article 6 of the Constitution continue. The author proposes their own interpretation of this mechanism.
