Abstract:

The article studies two terms for a subject’s behavior: limits of the reasonable and limits of the acceptable. For criminal proceedings, these concepts play an important role, since they define those boundaries and lines, crossing which can not only violate human and civil rights and freedoms, but also create offenses and crimes. Using the comparative legal method, structural method, and the analysis of the Russian criminal procedure’s legal norms, the author came to the following conclusions. The limits of the reasonable in criminal proceedings are the mental and conscious formation of lines and boundaries of the subject’s acceptable behavior within the criminal procedure’s legal relations, following the principles of reason, common sense, and conscience. The boundaries of the acceptable in criminal proceedings are behavioral limitations established by the criminal procedure’s legal norms within which the subject of the criminal procedure’s legal relations can exercise their obligations without being held accountable.
