The need to improve the current legislation encourages the state to develop optimal tools for regulating social relations. In this regard, not only the timeliness of the introduction or change of regulatory legal regulations, but also their qualitative elaboration is of particular importance. The example of the Russian law shows that the legislator pays considerable attention to the presence of a variety of protective measures. However, in some cases, they are insufficiently studied. Notably, in the example of legal rules, depriving previously imposed incentives present in various legal branches of the law. Their active use as a tool of punishment can significantly expand the list of protective measures and make the institution of punishment more flexible. At the same time, in the case of criminal and labor legislation, we can observe certain problems in the application of such rules.
This article contains proposals to optimize the consistency of the application of existing legal rules in certain areas of legislation.
