Abstract:

This article examines the legal description of the responsibility of the participants of the State program on rendering assistance to voluntary resettlement to the Russian Federation of compatriots living abroad. For clarity, regulatory changes must be made in paragraph 25 of the State program to comply with the provisions of the aliens Act. Also the wording of the provisions of paragraph 29 of the State program contradict Federal law. It is concluded that the departure of a participant of the State program and (or) members of his family in permanent residence of the subject of the Russian Federation, certain the certificate of the participant of the State program, earlier than two years from the date of his family in permanent residence of the subject of the Russian Federation, certain the certificate of the participant of the State program, earlier than two years from the date of entry into the territory of the Russian Federation, cannot be the basis for reimbursement of travel expenses and costs associated with registration of documents defining the legal status of the participants The state program on the territory of the Russian Federation. It is also indicated that the application of sanctions under paragraph 29 of the State program, in some cases, contrary to the principle of individualization of legal liability.
