Abstract:

The article focuses on integration of Roman private law into the Russian Civil law. The authors study the evolution of perpetual land tenure institute. The article gives the correlation of such concepts as "emphyteusis right" and "vektigal right", "kortom right" and "chinsh right", and comparative characteristics of the Roman Law institute "emphyteusis" and the institute of the Russian "chinsh use". Basing on the analysis of the historical development of the institution "emphyteusis", scientific approaches to this problem, the authors point out the distinctive features that characterize the institution of "emphyteusis" as a special kind of a limited property right. The relevance of the subject is caused by the development of a new RF Civil Code draft, and a number of amendments and additions to it. Thus, it is suggested that the institute of "emphyteusis", possessing the distinctive features alongside with the features of "chinsh use", should be introduced into the Russian Civil law.
