Unauthorized construction: problems of theory and practice

Abstract:

The article is devoted to the issue of legal regulation over unauthorized construction, being the basis of property law occurence. The authors analyzed the materials of court practice concerning the category of cases mentioned; contradictions and various approaches in the enforcement of the current legislation regulations are detected, in connection with the grounds of property law occurence. In particular, the function of Art. 222 provisions (the Civil Code of the Russian Federation) throughout a time period, the alternative order of property law for unauthorized construction recognition, apart from the court judgment, the possibility of applying property law to unauthorized construction of a person, not entitled with the real right for the land lot are considered. Summing up the results of the analysis conducted, the authors submit and substantiate the possible variants of the above mentioned problems and contraventions.
